Singer Sia has won a major court ruling in her ongoing custody battle with estranged husband Dan Bernad after a judge denied his emergency request for sole custody of their 19-month-old son, Somersault Wonder Bernad.
 
According to court documents obtained by People and TMZ, the judge ruled that "sufficient exigency for the requested emergency relief has not been shown at this time," noting that most of the issues raised had already been addressed in an earlier custody agreement reached on August 1, 2025. Under that arrangement, Sia retains primary custody while Bernad is granted limited, monitored visitation.
 
In his October 27 filing, Bernad accused the "Chandelier" singer of being "an unfit and unreliable parent struggling with substance abuse and addiction." He further described her behavior as "reckless, dangerous and demonstrates Sia's utter disregard for Summi's safety and well-being," alleging she had recently been hospitalized and tested positive for barbiturates and benzodiazepines.
 
Sia rejected the claims, declaring in her court response, "I have been fully sober for over six months and working my program which includes weekly testing and a sober companion." She added, "My recovery has been a cornerstone of my life and one of the primary reasons I chose to separate from Dan, whose ongoing engagement in a nightlife and recreational drug-use lifestyle is incompatible with a healthy environment for our child."
 
The 49-year-old artist also stated that her son "has always been in my primary care and custody," noting that Bernad had never "had custody of Summi for more than two hours at a time and [was] always monitored."
 
Sia's legal team, led by attorney Laura Wasser, argued that Bernad's claims were based on "old news," pointing out that he remains under monitored visitation due to a past LAPD investigation for alleged possession of child sexual abuse materials—an inquiry that was later closed with no charges.
 
Bernad, who says he is unemployed, had also requested $77,245 per month in child support and claimed Sia should cover all childcare and medical expenses. In her filing, Sia accused him of being financially motivated, writing, "To date, every request by Dan for additional custodial time has been directly tied to financial gain rather than a genuine effort to foster a meaningful parental relationship with Summi."
