Maurene Comey, a former federal prosecutor known for her work on high-profile cases involving Jeffrey Epstein, Ghislaine Maxwell, and Sean "Diddy" Combs, has filed a lawsuit against the Trump administration, alleging her removal was unlawful and politically motivated.
 
Comey, the daughter of former FBI Director James Comey, served nearly a decade in the U.S. Attorney's Office for the Southern District of New York. In her complaint, filed Monday in Manhattan federal court, she argues that her dismissal violated the Constitution. Her lawyers wrote, "Ms. Comey's termination — without cause, without advance notice, and without any opportunity to contest it — was unlawful and unconstitutional."
 
The lawsuit states that Comey was abruptly fired on July 16, 2025, one day after being asked to take the lead on a major public corruption case and just months after receiving an "Outstanding" performance review. According to court documents, she received an email attachment informing her she was being terminated "pursuant to Article II of the United States Constitution and the laws of the United States."
 
Her attorneys argue, "Defendants have not provided any explanation whatsoever for terminating Ms. Comey. In truth, there is no legitimate explanation. Rather, Defendants fired Ms. Comey solely or substantially because her father is former FBI Director James B. Comey, or because of her perceived political affiliation and beliefs, or both."
 
The complaint highlights that then-interim U.S. Attorney Jay Clayton spoke to her shortly after the firing. When asked why she was being removed, Clayton allegedly said, "All I can say is it came from Washington. I can't tell you anything else."
 
The lawsuit also points to political context. President Donald Trump dismissed James Comey as FBI director in 2017 and repeatedly criticized him afterward. The filing notes that two months before Maurene Comey's firing, her father posted on Instagram, which some Trump supporters interpreted as a threat against the president — a claim James Comey has denied. Soon after, activist Laura Loomer publicly called for Maurene Comey and her husband to be "FIRED from the DOJ immediately."
 
Defendants named in the lawsuit include the Department of Justice, the Executive Office of the President, and Attorney General Pam Bondi. The Justice Department has not commented on the case.
Comey's attorneys are asking the court to reinstate her position in the Manhattan U.S. Attorney's Office and prevent future removals without due process.
